Taylor Swift Free Prize Draw Terms and Conditions
FREE PRIZE DRAW
Each "Free Prize Draw" is offered to you by Universal Music Ireland Ltd.. We are a company registered in the Republic of Ireland under company registration number 30582 and our registered office is at 9 Whitefriars, Aungier St, Dublin 2. Universal Music Ireland Limited is the company that in these terms and conditions is called "Universal Music Ireland", "we" or "us". For all queries or issues with this Free Prize Draw however, please contact: info@taylorswiftmusic.co.uk - we will endeavour to respond to email messages within 5 working days.
TERMS & CONDITIONS AND UPDATES
These terms and conditions apply to the Free Prize Draw. Any persons who breach them may be excluded from access to the Free Prize Draw. These terms and conditions are between Universal Music Ireland Ltd. and those who are eligible for entry into the prize draw ("Entrant", "you"). It is your responsibility to read and understand these terms and conditions. We reserve the right, from time to time, and at our sole discretion, to change or update these terms and conditions. All changes to these terms and conditions will be published on our competition websites, either www.taylorswiftmusic.co.uk or www.independent.ie (the "Website(s)"). Upon publication, each change will become effective and you will be deemed to be aware of and bound by them. You should therefore review these terms and conditions regularly to ensure that you are up-to-date with all the current terms and conditions.
ELIGIBILITY
The Free Prize Draw is open to all permanent Rep. Of Ireland residents, who are aged 13 years and over and who enter the Free Prize Draw within the Qualifying Period. Any Entrant who is under the age of 18 may enter the Free Prize Draw with the consent of a parent or guardian. If an Entrant under the age of 18 goes on to win the Free Prize Draw, they may only claim the Prize with the consent of a parent or Guardian who must sign a copy of these terms and conditions and who must also agree to accompany the winner on the trip to London. Universal Music Ireland is not liable or responsible to any winner under the age of 18 who is unable to get the appropriate consent of a parent or guardian. The Free Prize Draw is not open to employees of Universal Music Ireland or Independent Newspaper (or its respective parent companies, affiliates, subsidiaries or agents), their immediate families and those professionally associated with this Free Prize Draw. The first and last name provided will identify the Entrant and if selected for the Prize, the winner, and any bogus name or email address will disqualify the Entrant. Decisions as to eligibility to participate in the Free Prize Draw shall remain with Universal Music Ireland whose decision shall be final and binding. In the event of any fault, misunderstanding, mistake or dispute concerning the operation of the Free Prize Draw, our decision as to how the matter shall be resolved shall be final.
ENTRY
All completed entry forms submitted by eligible participants on the Websites and received by us within the Qualifying Period, will be entered into the Free Prize Draw. The "Qualifying Period" for this Free Prize Draw is from 00:00:01 on 5 March 200 until 23:59:59 on 17 April 2009. Any entries received before of after this period will not be entered. The time of transaction, as recorded by Universal Music Ireland servers or servers acting on behalf of Universal Music Ireland, will be deemed to be the time of entry (and therefore whether the entry is within the Qualifying Period). We or our respective parent companies, affiliates, agents or subsidiaries accept no responsibility for incomplete, delayed or lost entries as a result of technical failures. There is only one entry per person and duplicate entries will be void. Entries and Prizes are non-transferable.
WINNER SELECTION
The Free Prize Draw will be held after the Qualifying Period and a winner will be selected at random from all eligible entries. A Universal Music Ireland employee will witness the winner selection process. This witness will also screen all winners for eligibility. We reserve the right to seek proof of age and identity to ensure compliance with the entry conditions. The requirements above in relation to residency and age also apply to the person accompanying the winner. No correspondence will be entered into and Universal Music Ireland's decision will be final. The winner will be notified within 28 days of the end of the Qualifying Period. If after reasonable efforts have been made we cannot contact the winner, or the winner is unable to travel on the selected dates, a new winner will be selected at random via the method above from all eligible entrants. The winner will be announced on independent.ie. The winner's details can be requested by writing to us referring to the name of the Free Prize Draw at our address set out above.
PRIZE
The "Prize" is one roundtrip for two to see Taylor Swift perform in Shepherd's Bush Empire, London on May 6th 2009 which comprises: Return travel (Standard Class air travel) from the winner's nearest major Irish airport to London Heathrow, Transfers to and from the airport in London, Hotel accommodation for 1 night, Tickets to see Taylor Swift. The approximate value of this prize is £750. All other travel, accommodation, expenses, charges (including but not limited to taxes and tipping) and travel insurance are not included as part of the Prize and responsibility for all expenses not specifically mentioned in this Prize package remains with the winner or person accompanying the winner. We reserve the right to offer an alternative prize. Any substitute offered will be of comparable value to the prize substituted. We have no liability for any prize which is lost or stolen or fails to reach the winner where this is beyond Universal Music Ireland's control.
PERSONAL DETAILS AND PUBLICITY
We will use your personal details to operate the Free Prize Draw. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree or to refuse this. Your personal details will be treated in accordance with our Privacy Policy from time to time and in accordance with the law as it relates to people's personal details. If you are the winner of the Free Prize Draw you agree that you will allow us to use your name and picture in marketing and publicity undertaken by us, which may be in more than one country and which may be in a number of media, for example, print, television, and internet. We will pay your reasonable expenses if we need you to make yourself available to be used in marketing and publicity of this sort.
GENERAL
Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. Otherwise, we will not be liable to you (or any person you select to accompany you in the case of Prize winners) for any matter relating to the Free Prize Draw offered by us. We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control - for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers. These terms and conditions form a legally binding agreement and by entering, Entrants will be deemed to have accepted and agreed to be bound by these terms and conditions. These terms and conditions shall be governed by the laws of Irish law, and are subject to the exclusive jurisdiction of the courts of the Republic of Ireland. If any provision of these terms and conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions, shall be enforced to the fullest extent allowed by law as to effect the intention of the parties, and shall not affect the validity and enforceability of any remaining provisions.
